Approval of the CIR was provided on June 6, 2007 (Attached). Unfortunately a "sunset clause" was added to SMART as part of the CIR appro= val. The SMART Building Products Committee is requesting that the "sunset c= lause" be removed from SMART=A9. SMART is a transparent consensus standard = and this request is on behalf of the SMART Building Products Committee. California Gold was included in the CIR; however we are specifically exclud= ing removal of the "sunset clause" from California Gold and any planned suc= cessor which would allow products containing PVC to be Certified. It was no= t known at the time of the CIR submittal by the Committee that California G= old would allow PVC to be included in certified products. SMART precludes PVC products to be certified due to the multiple adverse im= pacts in the supply chain including dioxin, toxic metals and endocrine disr= uptors. Even recycled PVC carpet presents endocrine disruptor health hazar= ds due to proximity of exposure that the California Statute bans in product= s: http://www.leginfo.ca.gov/pub/07-08/bill/asm/ab_1101-1150/ab_1108_bill= _20071014_chaptered.html SMART awards more points to organic biobased products with best management = practices (BMPs) than recycled products because organic production with BMP= s have no endocrine disrupting potential. The adverse health and environmental impacts of PVC have been recognized fo= r quite some time. Information on these impacts is well documented in the = LCA PVC study "Environmental Impacts of Polyvinyl Chloride Building Materia= ls" available at www.healthybuilding.net/pvc/Thornton_Enviro_Impacts_of_PV= C.pdf. NRDC concurs stating "Buy organic" to reduce endocrine disruptor exposure: = http://www.nrdc.org/health/effects/qendoc.asp For all these reasons, carpet companies have been making and marketing PVC = free carpet, some for many years. PVC free material is gaining much market = share and broader acceptance due to the need to protect public health and e= nvironment, as concluded recently by the State of California. We believe the "sunset clause" is without precedent and not warranted. Sin= ce comprehensive certification criteria (Certified Sustainable Product Eval= uation Criteria) were received by the TAG as part of our CIR Submittal and = your distribution to the TAG, we are not aware of any valid reason for this= clause to continue. The Certification Criteria were developed to document that the currently ap= proved versions of SMART are very robust and require among other provisions= , consensus, transparency, product environmental and social improvements ov= er all product stages, compliance with the Federal Trade Commission Environ= mental Marketing Guides, LCA, social equity, global auditing, ANSI Accredit= ed Process, and substantially reduce climate and other pollution over the g= lobal supply chain. We believe the "sunset clause" undermines LEED because it takes away the in= centive to receive innovation points if building owners and the design comm= unity know that LEED has temporary requirements. Owners and designers need= to rely on LEED provisions for certainty to substantiate the large capital= and labor investments to design and construct LEED certified buildings. The sunset provision takes away from the certainty and consistency required= in the market to encourage more LEED certifications, a top USGBC priority = due to the need to stop imminent, irreversible dangerous climate change. Ab= out 70% of SMART Credits reduce climate change over the global supply chain= For this reason, SMART is part of the AIA's efforts to reduce building en= ergy use by 50% by 2010. LEED Innovation Credits can clearly generate market transformation. However= , market certainty, which is critical to the transformation, is not present= with the SMART sunset clause becoming effective in just seven months. For = example, as a result of the SMART LEED Innovation Point, Forbo Flooring inc= reased it's wind energy use at its world's largest linoleum manufacturing f= acility from 6% to 100% in just two months for all of that facility's energ= y needs. Other manufacturers will follow, but only if market certainty is p= rovided. We respectfully request that the sunset clause be removed from the SMART Bu= ilding Products Standard immediately.
